1. Acceptance of Terms

By accessing or using ProofDoggy (the “Service”), operated by ProofDoggy (“we,” “us,” or “our”) at proofdoggy.com, you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, subscribers, and users of the Service. We may update these Terms at any time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

2. Description of Service

ProofDoggy is an AI-powered compliance-screening and marketing-assistance workspace designed for real estate professionals. The Service analyzes uploaded documents, images, and text for potential issues including Fair Housing language, grammar and copy errors, design and layout concerns, image copyright and trademark risks, and licensing or brokerage-identification requirements. It may also generate marketing copy on request.

ProofDoggy is powered by third-party artificial-intelligence technology, including Google Gemini. Analysis results are generated automatically and may be incomplete, inaccurate, or fail to identify all compliance issues or legal risks.

3. Not Legal Advice — Important Disclaimer

ProofDoggy is not a law firm and does not provide legal advice. The Service is a risk-screening tool designed to help identify potential compliance issues. Results generated by ProofDoggy do not constitute legal advice, legal opinions, or a guarantee of compliance with any applicable law, regulation, or rule.

You should not rely solely on ProofDoggy’s analysis as a substitute for review by a licensed real estate attorney, your supervising broker, or your state’s real estate commission. ProofDoggy is a supplementary screening tool only, and you remain solely responsible for the accuracy, legality, and compliance of any material you publish.

We make no representations or warranties that use of the Service will ensure compliance with the Fair Housing Act, state real estate advertising regulations, real estate commission or DRE requirements, copyright or trademark law, or any other applicable law.

4. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate account information and to keep it current.

You are responsible for maintaining the confidentiality of your account and access credentials, and for all activity that occurs under your account. Access tokens and subscriptions are for the individual subscriber (or, for Brokerage plans, the authorized seats only) and may not be shared with others outside your plan.

5. Subscriptions, Billing & Cancellation

ProofDoggy offers a free Starter tier and paid subscription plans. Plan features and current pricing are displayed on our pricing page and at checkout. By subscribing to a paid plan, you authorize us and our payment processor to charge the applicable fee on a recurring basis (monthly or annually, as selected) until you cancel.

Subscriptions renew automatically at the end of each billing period at the then-current rate for your plan, unless you cancel before the renewal date. “Founding rate” or other promotional pricing remains locked only for as long as your subscription stays continuously active; if you cancel and later resubscribe, promotional pricing may no longer be available.

You may cancel at any time through your account, and cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable. Payment processing is handled by a third-party processor, and we do not store your full payment card details.

6. Free Tier & Usage Limits

The free Starter tier includes a limited number of audits per calendar month. We may set, change, or enforce usage limits, and may modify the features available on any tier, at our discretion. We also rely on third-party AI providers and may experience temporary interruptions, capacity limits, or delays outside our control.

7. Acceptable Use

You agree not to use the Service to upload unlawful content, infringe the intellectual property or privacy rights of others, attempt to reverse-engineer or disrupt the Service, circumvent usage limits or access controls, or resell access without our authorization.

You represent that you have the right to upload any content you submit and that doing so does not violate any law or third-party right.

8. Your Content & Data

You retain ownership of the documents, images, and text you upload (“User Content”). You grant us a limited license to process your User Content solely to provide the Service, which includes transmitting it to our third-party AI provider(s) for analysis.

Our handling of personal information is described in our Privacy Policy. You are responsible for ensuring you have the right to upload any client or third-party information contained in your User Content.

9. Intellectual Property

The Service, including its software, design, branding, and content (excluding your User Content), is owned by ProofDoggy and protected by intellectual-property laws. These Terms do not grant you any right to use our trademarks or branding without prior written permission.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be complete or accurate.

11. Limitation of Liability

To the maximum extent permitted by law, ProofDoggy and its operator will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or relating to your use of (or inability to use) the Service — including any reliance on its analysis. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless ProofDoggy and its operator from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the Service at any time. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

14. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the “Last updated” date above. Material changes may be communicated through the Service or by email. Your continued use after changes take effect constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Washington, unless otherwise required by applicable law.
